What Is TREC Form 61-0?

TREC adopted Form 61-0 on May 4, 2026, and the official mandatory/effective date is July 1, 2026. The form is the Seller’s Disclosure about Groundwater and Surface Water Rights, and it helps buyers understand groundwater districts, wells, groundwater rights, surface water rights, and related water features tied to a property.

Who Must Complete It?

Sellers should use Form 61-0 when the applicable TREC contract/disclosure package requires groundwater or surface water rights information. The requirement is most relevant for rural, acreage, farm, ranch, and private-well transactions; Texas REALTORS notes it does not apply to the Residential Condominium Contract.

What the Form Requires

• The Groundwater Conservation District (GCD) governing the property
