What Is TREC Form 61-0?

Starting May 4, 2026, Texas real estate law requires sellers of properties with water wells to complete and deliver TREC Form 61-0 — the Seller’s Disclosure of Information on a Water Well Serving Drinking Water. This form must be provided to buyers before closing on any property that has a water well used as a drinking water source.

Who Must Complete It?

Any seller whose property has a water well that serves as a drinking water source is required to complete TREC Form 61-0. This includes residential, rural, and agricultural properties across all 254 Texas counties. The form is not required for properties served entirely by a public water system.

What the Form Requires

  • The Groundwater Conservation District (GCD) governing the property
  • Whether the well is permitted and the permit number if applicable
  • The number of active and plugged wells on the property
  • Well depth, casing material, and pump type if known
  • Whether the well water has been tested and the most recent test results
  • Any known issues with the well’s water quality or function
