1. Acceptance of Terms
By accessing TurnkeyWells.com (“Site”), creating an account, purchasing a report, or using any of our services (including the free GCD Lookup Tool), you (“User,” “you”) agree to be bound by these Terms of Service (“Terms”). If you are using our services on behalf of a company or other entity, you represent that you have authority to bind that entity to these Terms.
If you do not agree to these Terms, do not use the Site or purchase any reports.
Your agreement is formed when you:
- Click “I Agree” or “Accept” during checkout or account creation;
- Submit an order for any report; or
- Use the free GCD Lookup Tool.
2. Nature of the Service
TurnkeyWells provides automated data compilation reports based on publicly available government records related to water wells, groundwater conservation districts, and related information in the State of Texas.
What we do:
- Aggregate data from multiple Texas state agency databases
- Apply algorithms to compile, organize, and present that data in report format
- Provide statistical estimates derived from publicly reported data
What we are NOT:
- We are not a law firm and do not provide legal advice
- We are not a licensed professional engineering firm
- We are not a title company and do not perform title searches
- We are not a well drilling company and do not perform site assessments
- We are not a water testing laboratory
- We are not a licensed real estate inspector
All reports are generated automatically by algorithm without human review. No TurnkeyWells employee, contractor, or representative has reviewed, verified, or approved the specific contents of your report before delivery.
3. Data Sources and Accuracy
3.1 Data Sources
Our reports draw from the following public data sources:
- Texas Water Development Board (TWDB) Submitted Drillers Reports (SDR): Well completion data filed by licensed drillers. Drillers are required to file within 30 days of completion, but filings may be late, incomplete, or missing.
- TWDB Groundwater Database (GWDB): Historical groundwater data maintained by TWDB.
- TWDB Plugging Reports: Records of wells that have been plugged. Reports may lag actual plugging activity by weeks or months.
- Groundwater Conservation District (GCD) Boundaries: Based on 2019 TWDB boundary data. GCD boundaries may have changed since 2019 due to new district creation, annexation, or boundary adjustments. This data may not reflect current GCD boundaries.
- Texas Commission on Environmental Quality (TCEQ): Environmental and water quality regulatory data.
- US Census Bureau Geocoder: Used for address-to-coordinate matching. May produce inaccurate results for rural addresses, new construction, or addresses near county boundaries.
3.2 Known Data Limitations
You acknowledge and accept the following limitations:
- Pre-2001 data gap: An estimated 200,000+ wells drilled in Texas before TWDB began digitizing records are NOT included in our database. Our reports cannot and do not account for these wells.
- Filing lag: Well completion reports may not appear in state databases for 30+ days after drilling is complete. Recently drilled wells may not appear in our reports.
- GCD boundary staleness: Our GCD boundary data is from 2019. Districts created, expanded, or dissolved after 2019 may not be reflected. You must independently verify current GCD status with the relevant district or TWDB before making any decisions based on GCD information in our reports.
- Address geocoding: Our address matching uses the US Census Bureau geocoder, which may mislocate addresses – particularly in rural areas, for new construction, or near jurisdictional boundaries. We recommend verifying the mapped location shown in your report.
- Injurious water flags: These flags indicate proximity to historic driller reports mentioning injurious water conditions. They are NOT water quality assessments and do NOT replace professional water testing.
- Depth and cost estimates: All depth ranges and cost estimates are statistical projections based on nearby well data. They are NOT guarantees of what you will encounter at your specific location. Actual drilling conditions vary based on geology, equipment, and site-specific factors.
3.3 No Guarantee of Accuracy
TurnkeyWells does not guarantee the accuracy, completeness, or timeliness of any data in our reports. We compile and present publicly available data as-is. We are not the original source of this data and have no control over its accuracy at the source.
4. What Reports Are – and What They Are Not
4.1 Reports ARE:
- Informational compilations of publicly available government data
- Starting points for further research and professional consultation
- Convenience tools that save time aggregating public records
4.2 Reports Are NOT:
- Not a real estate disclosure. Our TREC Form 61-0 Disclosure Report is a data tool to assist sellers – it is NOT itself a legal disclosure and does NOT fulfill your disclosure obligations under Texas law. You remain solely responsible for the accuracy of any disclosure you file with TREC or provide to a buyer.
- Not legal advice. Nothing in our reports constitutes legal advice. Consult a licensed Texas attorney for legal questions.
- Not a title search. Our reports do NOT examine title records and CANNOT identify severed groundwater rights, mineral rights, or other title encumbrances.
- Not title insurance. Our reports provide no insurance or indemnification against title defects.
- Not a well inspection. We do not physically inspect any wells or properties.
- Not a water quality test. Our reports contain no original water quality data and do not replace laboratory water testing.
- Not a guarantee of drillability. Nothing in our reports guarantees that a well can be successfully drilled at any location, at any depth, or at any cost.
- Not a substitute for professional consultation. Before making any decision about drilling a well, purchasing property, or completing a real estate transaction, consult qualified professionals including licensed drillers, attorneys, and real estate professionals.
5. TurnkeyWells Accuracy Guarantee
5.1 What We Guarantee
TurnkeyWells stands behind the core data points in our reports. If we get either of the following wrong at the time the report was generated, we will make it right:
- GCD Membership Error: Our report states a property is or is not within a Groundwater Conservation District, and that statement was incorrect based on the official GCD boundaries in effect on the date the report was generated.
- Registered Well Existence Error: Our report states that a specific registered well does or does not exist at a location, and the TWDB Submitted Drillers Report database contradicts that statement as of the date the report was generated.
5.2 The Remedy
If you demonstrate a qualifying error under Section 5.1:
- We will refund the full purchase price of the affected report; AND
- We will pay you $500 as a goodwill accuracy credit.
5.3 What Does NOT Qualify
The Accuracy Guarantee does not cover:
- Depth estimates, cost estimates, or driller ratings
- Injurious water flag interpretation
- Aquifer identification
- Wells drilled before 2001 that are not in the TWDB database
- Address geocoding errors (wrong location mapped)
- Data that was accurate when the report was generated but changed afterward
- Any data sourced from GCD boundary files (our GCD boundaries are from 2019 – if a GCD was created or expanded after 2019 and our report reflects the 2019 data correctly, that is not an error under this guarantee)
- Omissions in state agency databases that are beyond TurnkeyWells’ control
- Subjective interpretations of report data
5.4 How to File a Claim
To file an Accuracy Guarantee claim:
- Email support@turnkeywells.com within 90 days of report purchase
- Include your order number and the specific data point you believe is incorrect
- Provide documentation from an official Texas state source (TWDB, GCD, TCEQ) showing the correct information as of the report generation date
5.5 Investigation and Resolution
TurnkeyWells will investigate your claim within 14 business days. We will compare your report against the source databases as they existed on the date of report generation. Our determination is final.
5.6 Limitations
- One claim per report
- Maximum of $500 in accuracy guarantee payments per customer across all reports, all time
- Claims made in bad faith, or without supporting documentation from official state sources, will be denied
- The Accuracy Guarantee is a goodwill remedy and does not create, expand, or modify any warranty, representation, or duty of care beyond what is stated in this section
6. Limitation of Liability
6.1 Liability Cap
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TURNKEYWELLS’ TOTAL LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING FROM OR RELATED TO YOUR USE OF OUR SERVICES OR ANY REPORT SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC REPORT GIVING RISE TO THE CLAIM.
The Accuracy Guarantee payments under Section 5 are included within (not in addition to) this cap, except that the $500 goodwill accuracy credit is offered as a separate voluntary remedy and does not increase the liability cap for other claims.
6.2 No Consequential Damages
IN NO EVENT SHALL TURNKEYWELLS BE LIABLE FOR:
- Lost profits or revenue
- Lost business opportunities
- Failed real estate transactions
- Cost overruns on well drilling projects
- Property value diminution
- Reliance damages
- Consequential, incidental, special, punitive, or exemplary damages
- Any damages arising from your reliance on report data without independent professional verification
This applies regardless of whether the claim is based on contract, tort (including negligence), strict liability, or any other legal theory.
6.3 Acknowledgment of Risk
You acknowledge that:
- Data reports are informational tools, not professional advice
- Real estate and well drilling decisions involve inherent risks
- You are solely responsible for independently verifying any information before relying on it
- TurnkeyWells has no control over the accuracy of source government databases
7. Indemnification
You agree to indemnify, defend, and hold harmless TurnkeyWells, its owners, officers, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney’s fees) arising from or related to:
- Your use of any report in a manner inconsistent with these Terms
- Your presentation of any report as a legal disclosure, professional opinion, title search, inspection, or any representation beyond what is stated in the report
- Your redistribution of any report without including the full legal disclaimer
- Your failure to independently verify report data before relying on it for any transaction or decision
- Any TREC disclosure you file that incorporates data from our reports – you are solely responsible for the accuracy of your filings
- Any third-party claims arising from your use of or reliance on our reports
8. Prohibited Uses
You may NOT:
- Resell report data or any portion thereof
- Remove, obscure, or alter any disclaimers, limitations, or attribution notices in any report
- Present any report as an independent professional opinion, legal advice, engineering assessment, title search, or property inspection
- Scrape, crawl, or systematically extract data from the Site or any reports
- Use our services to compile a competing database or product
- File false or bad-faith Accuracy Guarantee claims
- Use the Site in any way that violates applicable law
9. Intellectual Property and License
9.1 Ownership
All reports, compilations, algorithms, formatting, analysis methodology, and presentation are the intellectual property of TurnkeyWells. While the underlying government data is public, our specific compilation, organization, analysis, and presentation are proprietary.
9.2 License Grant
Upon purchase, you receive a limited, non-exclusive, non-transferable license to use the report for your personal or internal business purposes related to the specific property identified in the report.
9.3 Sharing Reports
You may share a report with parties directly involved in a transaction related to the subject property (e.g., your real estate agent, lender, title company), provided that:
- The report is shared in its entirety, including all disclaimers and limitation notices
- You inform the recipient that the report is subject to these Terms of Service
- You do not represent the report as anything other than what it is – an automated data compilation
10. Refund Policy
Because our reports are digital products delivered instantly upon generation, all sales are final. We do not offer refunds except:
- As part of a valid Accuracy Guarantee claim under Section 5
- At our sole discretion for service errors (e.g., report failed to generate, duplicate charge)
11. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.
12. Dispute Resolution
12.1 Binding Arbitration
Any dispute, claim, or controversy arising from or related to these Terms or your use of TurnkeyWells services shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in Tarrant County, Texas.
12.2 Class Action Waiver
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration against TurnkeyWells.
12.3 Small Claims Exception
Either party may bring an individual action in small claims court in Tarrant County, Texas, if the claim qualifies.
12.4 Injunctive Relief
Nothing in this section prevents TurnkeyWells from seeking injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property or enforce the Prohibited Uses provisions.
13. Updates to Terms
TurnkeyWells may update these Terms at any time by posting the revised version on the Site with an updated “Last Updated” date. Material changes will be communicated via email to registered users. Your continued use of the Site after any update constitutes acceptance of the revised Terms.
14. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
15. Entire Agreement
These Terms, together with any applicable Accuracy Guarantee Terms and Privacy Policy, constitute the entire agreement between you and TurnkeyWells regarding your use of the Site and services.
